Vietnam: Time limit for submission of certificate of origin for EVFTA imported goods

According to a report by Vietnam’s "Business Daily", the Ministry of Finance of Vietnam officially issued Announcement No. 07/2021/TT-BTC on January 25, 2021, stipulating the certificate of origin of imported goods applicable to the Vietnam-EU Free Trade Agreement (EVFTA) Time limit for submission.


imported goods enjoying the preferential tariffs of the Vietnam-EU Free Trade Agreement (EVFTA) shall submit the certificate of origin in accordance with the following time regulations:


1. Customs declarers are required to submit the certificate of origin of the goods when going through the customs formalities.


2. If the declarer is unable to obtain the certificate of origin when going through the customs formalities, the declarer must specify in the customs declaration form that the certificate of origin will be supplemented, and the certificate of origin must be supplemented within 2 years from the date of registration of the declaration (applicable for production The certificate is still valid).


3. If the customs declarer is unable to submit the certificate of origin on time due to force majeure and other reasonable reasons that cannot be managed by the importer, the Ministry of Finance and the General Administration of Customs of Vietnam will adjudge and decide whether the goods can enjoy the preferential conditions of EVFTA tariffs.


The Viet Nam General Administration of Customs ruling and deciding whether imported goods can enjoy EVFTA tariff preferences will be in accordance with the announcement of the Ministry of Finance of Vietnam on April 20, 2018 No. 38/2018/TT-BTC and No. 62/2020/TT-BTC on September 5, 2020 Announcement No. provides for handling. Announcement No. 07/2021/TT-BTC will come into effect on March 11, 2021.
