On November 6, the Ministry of Commerce held the “United Nations Convention on International Settlement Agreements Resulting from Mediation” and Opening-up Forum in Shanghai. The forum is one of the supporting events of the first China International import Expo. Assistant Minister of the Ministry of Commerce Li Chenggang attended the forum and delivered a speech. Luo Dongchuan, Vice President of the Supreme People's Court, and Anna Joubin-Bret, Secretary General of the United Nations Commission on International Trade Law attended the forum.
During the forum discussion, concentrated on the United Nations Convention on International Settlement Agreements Resulting from Mediation and China's opening up to the outside world, the two groups of guests discussed the historical evolution of commercial mediation, the content of the convention, the convention and business environment, and the impact of the convention on the international commercial dispute resolution mechanism, the convergence of the convention and the domestic laws, and the other issues which were highly concerned by the industry.
In June this year, the 51st Session of the United Nations Commission on International Trade Law adopted the draft United Nations Convention on International Settlement Agreements Resulting from Mediation, which will be submitted to the 73rd session of the UN General Assembly for consideration and approval later. The Convention aims at solving the cross-border implementation of settlement agreements reached by international commercial mediation and provides a new path for promoting diversified settlement of commercial disputes. The Convention will play an active role in enhancing the business environment of the state parties, promoting import and export trade as well as investment cooperation.
Attending were representatives from the Foreign Affairs Committee of the National People's Congress, the Supreme People's Court, the Ministry of Foreign Affairs, and other representatives from the China International Economic and Trade Arbitration Commission, important commercial dispute mediation agencies from home and abroad, practical representatives from well-known law firms, business representatives, relevant scholars and other guests.
